These terms govern all interactions between Bewafaqi and its clients, whether located in California or elsewhere. If you do not agree with any part of these terms, you must cease use of our services immediately. We reserve the right to modify these terms at any time without prior notice, and your continued use of our margin-based bidding strategies and POAS optimization tools constitutes acceptance of those changes.

California Consumer Privacy and Data Collection

In compliance with the California Consumer Privacy Act (CCPA), we disclose that Bewafaqi collects certain business and personal data necessary for Google Shopping Feed Optimization and inventory synchronization. This may include contact information, advertising data, and inventory metrics. As a user based in California, you have the right to request access to the data we hold, the right to request deletion, and the right to opt-out of any potential sale of your data. We do not sell your personal information to third parties; all data collected is used strictly to enhance your POAS and bidding efficiency.

Scope of Professional Marketing Services

Bewafaqi provides specialized PPC management focusing on Margin-Based Bidding and Profit on Ad Spend (POAS) conversion. While we strive for maximum profitability, the client acknowledges that digital advertising performance is subject to external market forces, algorithm changes by platforms like Google, and consumer behavior. Our services are provided on an “as-is” and “as-available” basis. We do not guarantee specific monetary outcomes, as our role is to optimize existing data and inventory feeds to the best of our professional ability based on the parameters provided by the client store.

Limitation of Liability and Indemnification

To the maximum extent permitted by California law, Bewafaqi and its owners shall not be held liable for any indirect, incidental, or consequential damages resulting from the use of our services, including but not limited to loss of profits, data loss, or advertising account suspensions. The client agrees to indemnify and hold Bewafaqi harmless from any claims, losses, or expenses arising from the client’s product inventory, store content, or violation of third-party advertising policies. Our total liability for any claim arising out of these terms shall not exceed the amount paid by the client for the specific service in question.

Intellectual Property and AI Tool Usage

All content, logic, and proprietary frameworks used in our Smart Inventory Sync and upcoming AI Profit Predictor tool are the exclusive intellectual property of Bewafaqi. Clients are granted a limited, non-transferable license to use the insights and reports generated during the service period. You may not reverse-engineer our bidding logic or redistribute our proprietary optimization techniques. Any unauthorized use of our “Profit-First” branding or technical feed structures will be subject to legal action under the jurisdiction of the state of California.

Governing Law and Dispute Resolution

These Terms and Conditions are governed by and construed in accordance with the laws of the State of California, United States. Any disputes arising from these terms or our PPC services shall be resolved through binding arbitration in California, rather than in court, except for small claims matters. Both parties agree to waive their right to a jury trial or to participate in a class-action lawsuit. If any provision of these terms is found to be unenforceable by a court of competent jurisdiction, the remaining provisions will remain in full force and effect.
